I have not gotten banned, however I know that Anet is serious with their user agreements. That is something that you agree to, and they hold the right to ban your account if you are caught violating their rules. I do know people who have gotten banned, so it isn’t like it is an empty threat.

Well I’m not stupid enough to risk my account buying gold so I’ve never been banned however I do know people that have been.
Arena net is very good at catching gold sellers and buyers. If you can’t earn enough gold legitimately to buy the stuff you need then you must be really bad at the game.
